i had to have a boil in my arm pit lanced. the doctor gave me some antibiotic and painkiller prescriptions. i filled them out. about 5 hrs after taking the meds i started vomiting and was having sever sweats and real cloudy thinking. i thought it was food poisoning. until the next morning. the pharmacy called me and said that they gave me the wrong prescription and that i had to return it. they gave me Effexor which is a big time anti depressant with alot of side effects. i had to drop a class and 3 day of work from this.. do i have a legal case?

Do you have a case? Good possibility but the question is what would you benefit. Contact a few attorneys and see what they think. Something similar happened to an uncle of mine several years ago but he never got anything out of it.

Yeah they messed up, BUT, (it seems) they contacted you as soon as they discovered the error. No one is perfect, and consider how many scripts the fill each day! You're fine now. right? THAT is what counts!!!!
I can live with honest mistakes, especially when people mnake their best effort to correct the problem. And...I really hate this sue-happy society we live in. So like was said, think about it before acting. Knee-jerk reactions usually bring less than desirable results. If I were to even consider legal action, I'd simply ask for reimbursment for lost time at work. And only then, if I was in dire straights and had to have the money to survive. Bottom line, don't get greedy! The biggest reason for outrageous health care costs is their having to have liability insurance to cover them against outrageous law suits.

I agree with Dennis. The cost of health care is getting so rediculous, And if you sued just for the time you had to take off from work the cost of attornys wouldn't justify it.

Man, glad you're OK. My wife was on Effexor briefly -- and had a psychotic reaction to it! That's bad stuff!!!

A similar thing happened to my mother. Her doctor put her on a new anti-siezure medication. She and my grandmother picked it up from the pharmacy and she began taking it. After three days, she was having SEVERE headaches. They called the doctor, who said, "You're on the lowest doseage of the drug that's available -- it couldn't possibly be causing a problem."

After two more days and another couple of calls to the doctor's office, they went back to the pharmacy out of desperation. When the pharmacist saw the pills that were in her bottle he nearly had a heart attack!

The pharmacy had put 220mg pills in the bottle labeled as 10mg! He told her that you have to work up to such a strong dose and that she could've had a brain hemorage and died!

It makes you wonder how often things like this happen and we never know about it?

well what happened was that i got my "prescription" and the bag was the darvocet with the instructions, but inside the bag was a different prescription. it was the Effexor. apparently when a person takes Effexor they are to start out at 20mg 2 times per day. then they slowly raise the dosage to the peak usage of 75 mg twice a day. well i got the 75mg ea dosage. the instructions on the bag said take 1-2 as needed, i was in pain, so i took 2. that was 150mg of Effexor. nearly 8 times the amount at startup. needless to say, i was FuC|<ed up. suprised i didnt OD actually. took me 4 days to get it out of my system and i still feel a lil "off". never knew anti-depressants could be so dang dangerous.

update
pharmacies corporate office called me today. they are making a claim and i will be reimburses $$$ that i missed while out of work for the 3 days... should be about 300.00. the kicker is that the guy said that i will probably also be getting some money for my discomfort and rite aids negligence... nice huh..... im not asking for to much.. just the money for the co-pay and the money lost from work. i also lost a few hundred cuz i had to drop a class, so that would be nice. now discomfort/negligence? whats that worth? maybe a new dana 44 front end?

If I were you I'd be happy that they already are trying to work it out with you.
Like said: America is (getting) way too sue happy these days, hence the rising cost of everything Roll Eyes

BTW: Europe is following the lead, but they're already putting 'caps' on the legal 'compensation stuff', so I guess they learned/are learning from the outrageous things that are happening in the US Eek

Sorry to hear it didn't work out better for you. One thing we do is look up all our prescriptions in a Physicians Desk Reference. You can pick it up at any bookstore, and it has pix of pills as well as the names, side effects, generic equivalents and what other drugs they will react with. Handy to have!
