ok so maybe some of you remember a thread a while back when i got some pain killers from a Rite Aid pharmacy. they gave me hard core heavy duty anti depressants instead and i had severe reactions to it. i missed a few days of work and had to drop some of my college courses.
anyways i have talked to a few attorneys and none seem to want to touch it because no permanant damage occured. today i get a letter from an arbitrator and they want to settle by giving me 500.00. should i do this or should i pursue?.

i was throwing up and severely dizzy and had severe sweats and couldnt eat for about 3 days straight. i couldnt think hardly at all. i took 4 times what a person that would be starting up on this med should take. who knows if im wacked from it . i was wacked before Eek. should i just take the 500 and run with it?

A couple of thoughts:

1. If you haven't done so already, go to your doctor and get checked out. Just because you feel better, are no longer sick, etc., doesn't mean you weren't damaged permanently. Always nice to get a professional opinion. Once you take the money, it's all over - no second chances.

2. You didn't say how you picked the lawyers, but it's worth noting that most injuries are not permanent - broken bones, gunshot wounds, all will heal with little or no residual effects. That doesn't mean you weren't hurt at the time, does it? I'm having a hard time believing that a good personal injury lawyer doesn't see a case here - and if it happened to you, how many more have they messed up? Class action, anyone?

That's how it looks from over here. YMMV.

I'll definitely second that opinion. I'm not one to go sue-happy on folks, but this case has WIN written all over it.

If the pharmacy is offering a settlement, to me that implies they admit their culpability. While a jury trial is a crap shoot, it would appear to me that this offer would help your case. Of course justice and law often vary extensively.
